  1. “Player hereby represents and warrants (except as otherwise disclosed to club in writing), as of the date hereof, that (1) Player has not been charged with, indicted for, convicted of or pled nolo contendre to any felony and/or misdemeanor involving fraud or moral turpitude, (ii) Player has not engaged in conduct which could subject him to a charge, indictment or conviction of any such offense, and (iii) no circumstances exist that would prevent Player’s continuing availability to the Club for duration of this Contract”.

    Looks fairly clear that if the new lawsuit wasn’t disclosed before signing the contract, that there’s a way out. I also think that despite this entire deal being a nightmare, we would’ve at least protected ourselves well enough in case of this happening.

    If we were able to get out of the deal, we would leave him on the roster until the new league year starts and cut him post 6/1 which would mean a 2025 dead cap hit of $30M and a 2026 dead cap hit of $50M.

    We would most importantly stop having to pay him any cash freeing up $46M to spend on a new QB or draft a QB and spend that money elsewhere on the roster.

  2. I’m no lawyer but isn’t this a civil case? It appears to me that that paragraph talks about criminal charges and therefore this “new” suit doesn’t fit. Also it makes it seem like he had to hide a lawsuit from the league or the Browns at the time of the signing, but this lawsuit is three years post facto, so how would it “activate paragraph 42?”

    Please correct me if I’m wrong.

  3. This isn’t mind blowing to anyone who paid attention when they acquired the guy. If a new undisclosed allegation came out then his contract could be voided. And if it was disclosed, then nothing changed. I’m not losing any sleep over details we don’t have yet.
